General Terms and Conditions

Courses, workshops, healings, coaching/mentoring sessions and rituals in organisation of Vizualia

Article 1: Scope

  • These general conditions apply to all offers and agreements of clients or (potential) participants concerning courses, workshops, healings, coaching sessions and rituals.
  • The latest version of our General Terms and Conditions shall invalidate all previously issued documents.
  • An agreement with regard to following a course, workshop, coaching, healing or ritual comes into being through the submission of an application form by the client or (individual) participant(s) and the provision of proof of registration by Vizualia; this can be done through an (automatic) confirmation email.

 

Article 2: Registration

  • All courses, workshops, trainings or education sessions are organised subject to sufficient registrations. Vizualia reserves the right to cancel a session at any time.

 

Article 3: Payment

  • After the booking or registration, an invoice will be made out. This will be sent to the e-mail address provided. If desired, an invoice can be sent by post. For this, an administrative cost of €1.00 (one euro) will be charged.
  • The participant must pay the entire claim within 14 days of the invoice date, unless explicitly agreed otherwise in writing with Vizualia.
  • Payment in instalments is negotiable and will be recorded in writing for complete programmes and training courses.
  • In the event of failure to meet the agreed instalments on time, this instalment agreement shall lapse without notice and the participant shall no longer be entitled to claim it. In this case, the total amount will be collected immediately.
  • If an invoice is not paid on time, Vizualia e reserves the right not to allow the registered person to attend the session, workshop or refresher course.
  • If invoices are not paid on time, an administrative cost of €15.00 (fifteen euros) will be charged from the first reminder sent, without any prior notice of default.

 

Article 4: Cancellation and modification

  • Cancellation or change of a course, workshop, session, ritual by a participant (or his or her client) must be made in writing. The date of the postmark or e-mail of this letter is considered to be the date of cancellation.
  • In the event of cancellation up to two weeks before the start of the workshop, a credit and refund will be possible. Thereafter, no refund or compensation will be made under any circumstances or in any form.
  • In the event of being unable to attend, participants may appoint a substitute up to 24 hours before the start of the workshop. This should also be reported in writing via anke.colson1@telenet.beor 0486847062
  • If a participant chooses to cancel during a course, workshop, coaching or mentoring session, they are not entitled to any refund of the participation fee.
  • If the participant does not appear, he is not entitled to any reimbursement or compensation of participation fees.
  • Vizualia has the right to make organisational and/or content changes to courses, workshops, session, rituals at any time.

 

Article 5: Intellectual property

  • Vizualia reserves all rights of intellectual and industrial property with regard to the materials provided by Vizualia. The participant is not entitled to hand over, give in use or distribute in any way to third parties course, workshop, training or education materials, to which rights as referred to above belong to Vizualia.

 

Article 6: Execution of the order

  • If Vizualia is unable to perform due to circumstances that were not known at the time the agreement was concluded, Vizualia shall have the right to amend the agreement in such a way as to make its execution possible.
  • Vizualia shall be entitled to suspend fulfilment of its obligations if it is temporarily prevented from fulfilling them as a result of changes in circumstances that could not reasonably be foreseen at the time of concluding the agreement and which lie outside its sphere of influence.
  • Vizualia strives to ensure that the planned course, workshop, training or session always goes ahead. If, however, circumstances prevent a particular course, workshop, training or session from taking place, Vizualia is not liable to the participant for this. If possible, Vizualia will arrange for a substitute course, workshop, session or ritual, possibly provided by another employee. If Vizualia is unable to offer a substitute course, workshop, training or education, the participant has the right to a partial or full refund of the paid participation costs, depending on the part that could not be executed.
  • The agreement entered into with Vizualia results in an obligation to perform to the best of one's ability, not an obligation to achieve a certain result.

 

Article 7: Complaints - disputes

  • Any complaints about services or materials delivered by Vizualia must be made known to Vizualia in writing, stating reasons, within 7 days of delivery at the latest. Failing this, the client/participant is deemed to have agreed to the services or materials delivered.
  • The submission of a complaint does not release the client or (potential) participant from its payment obligation.

 

Article 8: Liability

  • Vizualia excludes any liability for damage or accidents that occur on the site, insofar as this is not opposed by mandatory law.
  • If renewed fulfilment of the assignment is not possible, any liability on the part of Vizualia shall be explicitly limited to an amount equal to the amount that Vizualia has or could have charged the client with respect to this agreement. Any further liability is therefore explicitly excluded, insofar as this is not opposed by mandatory rules of law.
  • No rights can be derived from the contents of brochures or website texts.

 

Article 9: Other stipulations

  • Belgian law applies to the agreement between Vizualia and the client (participant).

 

Article 10: Personal data

  • Unless the client explicitly indicates otherwise, the client grants Vizualia permission to include personal data of participants in its database for informational purposes upon entering into an agreement. Vizualia shall manage this data carefully and in accordance with legal requirements; it shall only use it for its own purposes and shall not make it available to third parties.
